Lawyer Scott Robertson says the Doctrine of Discovery ‘rears its head’ today whenever Indigenous groups assert their sovereignty in opposition to projects on their territory.
Indigenous leaders are pushing Pope Francis to repudiate the 15th-century doctrine that provided European colonizers with a legal and moral framework for the seizure and subjugation of Indigenous territory, while also pointing out that the doctrine and its legal offspring still play a key role in Canada today.
Scott Robertson, a senior associate at the law firm Nahwegahbow Corbiere and a former president of the Indigenous Bar Association, told The Hill Times that the Doctrine of Discovery and the legal structure that grew out of it “permeates throughout our entire democratic system.”
