The Kebaowek First Nation is celebrating a big win in Federal Court last Wednesday when it was ruled the Canadian Nuclear Safety Commission (CNSC) failed to consult the community when it gave a radioactive-waste storage site the go-ahead.
The decision acknowledges that the CNSC failed to uphold its duty to consult in a manner consistent with the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) and failed to consider UNDRIP in its decision-making process in implementing the site.
