Changing the rules without informing company amounts to “taxation by ambush” judge says
Try as they might to save a few million dollars on the sly, the Government of Nunavut is now on the hook for nearly $2 million in fuel rebates owed to Agnico Eagle Mines Ltd., the company that owns the Meadowbank gold mine in Nunavut’s central Kivalliq region.
In an Oct. 30 written judgment that chastises the GN for changing the rebate rules without telling the only company it would currently impact — Agnico Eagle — Nunavut Court Justice Andrew Mahar said the mining company was entitled to $1.95 million in rebates that the GN tried to deny.
“If it was too much trouble to update the official Government of Nunavut guidelines or the rebate claim forms, it would surely not have placed too great a burden on the Government of Nunavut for someone to send an email,” Mahar wrote in his judgment.
