The Alberta Energy Regulator (AER) has received Oil Sands Conservation Act (OSCA) Application No. 1739105 from MEG Energy Corp. (MEG) for approval of its Surmont project. The AER is reviewing the application together with Environmental Protection and Enhancement Act (EPEA) Application No. 001-308611, Water Act File Nos. 001-00317202 and 001-00317315, and the environmental impact assessment (EIA).
A joint notice of application was issued by the AER and Alberta Environment and Sustainable Resources Development (ESRD) on January 30, 2013, setting a deadline of April 19, 2013, for filing statements of concern with respect to the EPEA application and Water Act files. No deadline was established for filing statements of concern with respect to the OSCA application. This notice sets the deadline for filing statements of concern with respect to the OSCA application.
Description of the Project
MEG has applied under section 10 of the OSCA, part 2, division 2, and section 66 of the EPEA for the construction, operation, and reclamation of the Surmont project and under section 50(1) of the Water Act for withdrawal of water from the Grand Rapids Formation for domestic and utility purposes during construction of the project and from the Clearwater Formation for steam generation and utility during the life of the project. The project would use steam-assisted gravity drainage (SAGD) recovery to produce bitumen from the McMurray Formation. The project would have a maximum bitumen production capacity of 19 544 cubic metres per day (m3/d) (123 000 barrels per day). The project would include
The estimated life of the project would be 25 years. The project would be located in Townships 81 and 82, Range 5, West of the 4th Meridian, in the Regional Municipality of Wood Buffalo, about 80 kilometres south of Fort McMurray, Alberta.

Confidentiality
Sections 49 of the Alberta Energy Regulator Rules of Practice (Rules of Practice) require that all documents and information with the AER be placed on the public record. If you file a submission, you must not include any personal information that you do not want to appear on or are not authorized to put on the public record. Section 49(2) of the Rules of Practice states how to apply to the AER for an order to keep information confidential. Any request made under section 49 must be copied to the other parties to the proceeding. Section 49 of the Rules of Practice is available on the AER website at www.aer.ca.
Jurisdiction
Submissions relating exclusively to compensation for land use are not dealt with by the AER and should be referred to the Alberta Surface Rights Board.
Under section 21 of the Responsible Energy Development Act, the AER does not have jurisdiction to assess the adequacy of Crown consultation associated with the rights of aboriginal peoples as recognized and affirmed under the Constitution Act, 1982.
