As former Snuneymuxw chief Doug White has indicated, the impact of the recent Supreme Court of Canada decision — Tsilhqot’in Nation v. British Columbia — cannot be underestimated.
The case is the first in Canada that upholds the right of aboriginal title, recognizing nearly 2,000 square kilometres that are under the jurisdiction of the Tsilhqot’in First Nation.
White, now director of the new Centre for Pre-Confederation Treaties and Reconciliation at Vancouver Island University, points out that the decision ends the ability of the resource sector to initiate projects on land under aboriginal title without first obtaining the consent of the First Nation in question.
