3 things you should know about the new anti-spam law

On July 1, new anti-spam legislation governing the way companies communicate with clients or prospective clients will kick in across Canada.

Under Canadian Anti-Spam Legislation (CASL), businesses and organizations must seek express consent before they are allowed to send any commercial electronic messages (CEMs). This includes emails, text messages and any form of social media.

Described by some as the strictest anti-spam policy in the world, the law allows regulators to fine businesses that do not comply for up to $10 million per violation.

What does this mean for you if you run your own company? You must:

  • obtain consent;
  • clearly identify your company; and
  • provide an unsubscribe mechanism in all communications.

If you’re an entrepreneur, here are three other things you need to know about Canada’s new anti-spam law:

1. Are you sending a CEM?

Any electronic message which encourages the recipient to participate in any commercial activity falls under the new legislation.

For example, “the inclusion of a logo, a hyperlink or contact information in an email signature does not necessarily make an email a CEM. Conversly, a tagline in a message that promotes a product or service that encourages the recipient to purchase that product or service would make the message a CEM.”

Some examples of this type of marketing include:

  • offers to purchase, sell, barter or lease a product, goods, a service, land or an interest or right in land;
  • offers to provide a business, investment or gaming opportunity;
  • promoting a person, including the public image of a person, as being a person who does anything referred to above, or who intends to do so.

If you are a charity that sends messages to seek donations, recruit volunteers or invite neighbours to a free community event, CASL does not apply.

2. There is a grace period

Because of the sweeping nature of the new law, the legislation includes a transitional provision that relates to the consent requirement. Consent to send CEMs is implied for a period of 36 months beginning July 1, 2014, where there is an existing business or non-business relationship that includes the communication of CEMs.

This three-year period of implied consent ends if the recipient makes it clear that they no longer consent to receiving messages.

3. US businesses are affected

Even if your business is located outside of Canada, it does not mean you are exempt. If you’re sending email to anyone who resides in Canada, you must abide by the new requirements.
