MCK served with legal proceeding regarding quarry restoration

(Kahnawake – 5 Onerahtohkó:wa/May 2026) The Mohawk Council of Kahnawà:ke (MCK) wishes to inform the community that it was served on the afternoon of Friday, May 1, 2026, with a legal proceeding brought forward by J.F.K. Quarry G.P., a locally owned and operated business conducting quarrying activities within the Territory of Kahnawà:ke.

The Plaintiff is seeking an injunction from the Superior Court of Quebec that would order the MCK not to impede, obstruct, or otherwise prevent the implementation of its quarry restoration plan.

According to the application, the Plaintiff alleges that delays associated with MCK authorization requirements, including the processing of its permit application under the Kahnawà:ke Sanitary Conditions Law (KSCL), will result in imminent harm. This includes alleged claims of lost business opportunities and profits, as well as the potential loss of the 2026 operational season.

In addition, the Plaintiff argues that the KSCL exceeds the regulatory authority granted to band councils under the Indian Act in relation to environmental matters, inspector powers, and penalties.

As this matter is now before the courts, the MCK will not be providing further comment at this time. However, the Ratitsénhaienhs wish to ensure that the community is informed of this legal proceeding, given environmental protection is an important issue for the community.
